Mountain Guide beings: Mountain Guide/Canyoning Guide/Sport Climbing Instructor - Temporary Service (Excursion Traffic)

General information

Mountain guides, canyoning guides and sport climbing instructors from other provinces or foreign states may temporarily operate in Vorarlberg for occasional excursions without having to acquire a licence or permit according to the Vorarlberg regulations.

Deadlines

The Mountain Guides Association (Bergführerverband) must be notified in advance of the commencement of the activity. This notification must be renewed every 2 years.

Costs and fees

As a rule, no fee is payable.

If, however, the Mountain Guide Association identifies deficiencies in the declared qualification that could lead to a serious risk to the health and safety of the guided person or the accompanying persons, this will be determined by the Provincial Government (Landesregierung) by means of an official decision. Administrative charges and fees are due under the Federal Law on Dues (Gebührengesetz) for this notification.

EUR 83.60 fee for the official certified copy, in accordance with the Federal Law on Dues

Further costs depend on the number of appendices submitted (EUR 3.90 per sheet (= four DIN A4 pages), maximum EUR 21.80 per appendix).

If a report by a non-official expert is necessary, this will be communicated separately in advance.

Requirements

The Mountain Guides Association must be notified in advance of the commencement of the activity.

The following evidence must be attached to the notification:
a) evidence of nationality,
b) evidence of professional qualifications,
c) evidence of the content and scope of completed training and examinations (curricula and similar),
d) evidence of legal establishment in the country of origin,
e) if this profession is not regulated in the Member State of origin, evidence of corresponding professional practice of at least 1 year's duration in the previous 10 years, and
f) if relevant, a certificate documenting a change of name.

Evidence can be submitted either as originals or copies. If there is any doubt about the authenticity of a document, a certified copy may be requested. For evidence listed in letters a) to d), a translation by
a certified translation agency must be enclosed upon request for all documents not in German.

Mountain guides, canyoning guides and sport climbing instructors from other provinces or foreign states may temporarily operate in Vorarlberg for occasional excursions without having to acquire a
licence or permit according to the Vorarlberg regulations. The Mountain Guides’ Association must be notified in advance of the commencement of the first activity as a mountain guide, canyoning guide or sport climbing instructor in a given year. The evidence mentioned under ‘Requirements’ must be attached; the Mountain Guide’s Association will check it.

In any case, the professional qualification of an non-resident mountain guide, canyoning guide or sport climbing instructor is presumed if they hold a certificate from an international association of mountain guide associations.

If the Mountain Guides’ Association identifies deficiencies in the notified qualification that could lead toa serious risk to the health and safety of the guided person or the accompanying persons, the Mount Guides’ Association will inform the Provincial Government. The Provincial Government will determine the deficiencies by means of a decision. The applicant will then be given the opportunity to make up for the lack of qualifications by taking an aptitude test with the Mountain Guides’ Association.

Authentication and signature

An electronic or handwritten signature is not required for applications.

Means of redress or appeal

Appeals against decisions of the Provincial Government may be lodged with the Regional Administrative Court (Landesverwaltungsgericht). The appeal must specify the contested
decision and the authority that issued it. It must contain a request and set out the grounds on which the allegation of illegality is based.

The appeal must be filed in writing to the relevant competent provincial government within 4 weeks of the date of notification of the
decision and must contain information that makes it possible to assess its timeliness. The appeal may be filed electronically: Appeals in administrative proceedings.
