Ski School beings: temporary service ("excursion traffic")

General information

Ski schools from other provinces or foreign states, as well as non-resident ski instructors, may temporarily operate in Vorarlberg for occasional excursions without having to acquire a licence or permit according to the Vorarlberg regulations. Temporary and occasional activities are those that are not carried out for more than a total of 1 month per winter season.

Deadlines

The Ski Instructors’ Association (Schilehrerverband) must be notified in advance of the start of the first activity of a given year. This notification must be renewed every 2 years.

Costs and fees

As a rule, no fee is payable. If, however, the Ski Instructors’ Association identifies deficiencies in the declared qualification that could lead to a serious risk to the health and safety of the guided person or the accompanying persons, any fees will be determined by the Provincial Government (Landesregierung) by means of an official decision.

Further costs depend on the number of appendices submitted (EUR 3.90 per sheet (= four DIN A4 pages), maximum EUR 21.80 per appendix).

If a report from a non-official expert is necessary, this will be communicated separately in advance.

Legal bases

Section 17 of the Ski School Act (Schischulgesetz) and the Regulation of the Provincial Government on the detailed requirements for non-resident snow sports instructors and for instructors and candidates of foreign ski schools on excursions (Verordnung der Landesregierung über die näheren Voraussetzungen für auswärtige Schneesportlehrer
sowie für Lehrkräfte und Anwärter von auswärtigen Schischulen im Ausflugsverkehr).

Requirements

The Ski Instructors Association must be notified in advance of the start of the activity of the foreign ski school or the non-resident ski instructor.

The notification must contain the following documents:

I) with regard to instructors coming to Vorarlberg for the first time, including candidates:

a) evidence of nationality,
b) evidence of professional qualifications,
c) evidence of the content and scope of completed training and examinations (curricula and similar),
d) evidence of legal establishment as a self-employed snow sports instructor or as a ski school,
e) if this profession is not regulated in the Member State of origin, evidence of corresponding professional practice of at least 1 year's duration in the previous 10 years, and
f) if relevant, a certificate documenting a change of name.
Evidence items a) and b) must be submitted in the original version or as a certified copy and with a certified translation. For the other evidence items, a copy with a simple translation is sufficient.

Ski schools from other provinces or foreign states, as well as non-resident ski instructors, may temporarily operate in Vorarlberg for occasional excursions without having to acquire a licence or permit according to the Vorarlberg regulations. The Ski Instructors’
Association must be notified in advance of commencement of the first activity of the ski school in a given year. The evidence mentioned under ‘Requirements’ must be attached; the Ski Instructors’ Association will check it.

If the Ski Instructors’ Association identifies deficiencies in the notified qualification that could lead to a serious risk to the health and safety of the guided person or the accompanying persons, the Ski Instructors’ Association will inform the Provincial Government. The Provincial Government will determine the deficiencies by means of a decision. The instructor concerned will then be given the opportunity to make up for the lack of qualifications by taking an aptitude test with the Mountain Guides’ Association
(Bergführerverband).

Authentication and signature

An electronic or handwritten signature is not required for applications.

Means of redress or appeal

Appeals against decisions of the Provincial Government may be lodged with the Regional Administrative Court (Landesverwaltungsgericht). The appeal must specify the
contested decision and the authority that issued it. It must contain a request and set out the grounds on which the allegation of illegality is based.

The appeal must be filed in writing to the relevant competent provincial government within 4 weeks of the date of notification of the decision and must contain information that makes it possible to assess its timeliness. The appeal may be filed electronically: Appeals in administrative proceedings.
